The way that your insurance claim is handled will depend somewhat on whether you are the insured or the claimant. Being the insured means that your insurance company is handling your injuries, and whatever payments are made will come from your own coverages as listed on your policy. Being the claimant means that the other person’s insurance company will handle your injuries, and the payment will come from that driver’s bodily injury liability coverage.

Claimants generally have more flexibility in what they can obtain for an insurance claim. First-party medical coverages are usually fairly limited, and you are bond to the limitations of your policy. For example, if you have personal injury protection coverage with a $2,000 limit, your insurance company will never be able to pay you more than $2,000 for injuries, even if your medical expenses are much higher.

On the other hand, bodily injury liability coverage generally has higher limits, and claimants may be able to get more assistance with medical expenses as the third-party insurance carrier does not want to be sued. This gives you as a patient more leverage against another insurer if you are not at fault for the accident that caused your injuries.

The primary exception to the above-mentioned phenomenon is if you live in a no-fault insurance state. These states, like New York and Florida, limit the amount that you are able to receive in medical benefits as a claimant; they also place limits on your ability to sue for injuries. In order to compensate, most people in these states carry better first-party medical coverages. Although these coverages do still have limitations, they are more flexible than in states without no-fault laws.

Can I Get Pain and Suffering Payments for a Car Accident?

Insurance companies will generally offer a lump-sum settlement based on all of the expenses related to the medical portion of the claim. This means that the settlement will usually include reimbursement for doctor’s visits, prescription drugs, physical therapy appointments and other medical costs in addition to compensation for missed work and general compensation for pain and suffering.

The insurance company will usually offer an initial settlement very early in the claims process, especially if the injuries reported seem minor. The reason for this is that once the patient accepts the settlement, they usually cannot qualify for additional funds. This allows the insurance company to save money on the claim as the full extent of injuries is often not noticeable until several days or even months after a collision.

This initial settlement is negotiable, and it may be in your best interests to negotiate the sum with the insurance company. Bear in mind however that the insurer does not need to honor any requests that you make, especially if those requests are unsubstantiated. If you want to get more money from the insurance company, you will need to provide proof of why you need the funds. The more documentation you have, the more likely you will be able to receive an ample settlement.

Depending on the circumstances, it may be worthwhile to hire an attorney to help you get the maximum amount available for your claim. It may be easier to get paid for pain and suffering if you file a lawsuit rather than sticking to the claims process. Additionally, the insurance company may be more likely to try and settle the claim with you quickly if they know you’re considering hiring an attorney; this could provide good leverage for obtaining the funds that you need.

On the other hand, hiring an attorney limits your options substantially. Once you become attorney-represented, your attorney must handle all communications with your insurance company. You cannot call the adjuster or handle any part of your insurance claim. This can be a massive inconvenience if the repairs have not yet been completed and the attorney is only handling your injuries; it can lead to your claim becoming locked in a stalemate where the insurance company cannot talk to you and your attorney cannot complete the claims process.

Your best bet is to carefully assess each individual situation and determine what you believe is fair. You may wish to consult an attorney without retaining one at first to determine what your best course of action should be. You can also honestly discuss your concerns with the insurance adjuster to see what your chances of receiving a fair settlement will be. $100,000 Settlement With Liberty Mutual for Back Surgery from Car Accident

A woman was driving her car in Homestead, Miami-Dade County, Florida. She was rear ended by a driver.

After the crash, she told her doctor that she had lower back pain. She treated with a chiropractor for a few months but the pain did not go away.

When a renters insurance policy holder for liberty mutual has someone injured inside of their home, due to their negligence, does liberty mutual make a direct payment to the claimant/claimants or to the institutions that they received medical charges from for the injuries occurred?

If Liberty Mutual believes that its insured is negligent, it will generally offer to settle the personal injury claim under the liability coverage portion of the renters insurance policy by making a direct payment to the person who is injured.

The Liberty Mutual insured may also have medical payments coverage on his or her homeowners insurance policy. Liberty Mutual may pay the injured person or make payments to the medical provider.

Sometimes, a renters insurer will place the hospital on the check. They are not allowed to do this in Florida. If Liberty Mutual insists on adding a hospital on the settlement check from the bodily injury coverage under the policy, I would file a civil remedy notice of insurer violation against them and submit a request for insurance assistance and file a complaint with the Florida Department of Financial Services.

1) If you have LTD through work with LM, get different insurance! If you are not able to do this remember the following:

a) Remember that your human resource person works for the company not the employees. Get everything in writing and save every email at home. I had mine at work and it was all shredded before I was able to pick up my things!

b) The LM representative's job is to deny coverage by any means possible! Never say you are fine or OK, use the phrase "˜as well as can be expected' everything you say will be used against you!

c) Request the entire LTD policy! Most policies have:

i. Have only 1 appeal and then no new evidence can be introduced after that

ii. SSDI is subtracted out of your benefit payments

iii. You are not able to collect punitive damages

iv. There are a ton of loop holes and the wording is confusing

d) LM will pay benefits for about 2 months and then start suspending payments. Most common reason is the doctors' are not sending notes, even thought some were faxed in 4 times in my case.

i. This allows the company to show corporations that they pay benefits so they can sell more policies!

e) If denied benefits payments request the entire administrative file, before you file your appeal. This will prevent the surprises I had (more on this later).

f) If denied benefits payments get a lawyer ASAP

i. Good luck if you make less that $50,000 a year. This is because LM does not settle cases; they force the civil suit to be filed

She is twisting everything I say.

. she claims she has not received papers from my doctor. now she wants information from other doctors unrelated to my claim.If I say I am fine..she used that against me.

Yes, I agree. Liberty Mutual will gladly take your monthly payment but when it's time to pay me for a work related disability, they deny it every step the way. I was forced to hire an attorney.

What were th surprises

Hiring a lawyer now, I was sent a bogus w2 for 2014, I filed my taxes using a professional from h and r block.Now that I am at 3rd level appeal with SSDI and have had my benefits suspended at least four times in 2 years claiming they didn't get paperwork which my husband faxed in and we have a confirmation they received it.

My w2.states I got 10k more than I did. Glad I saved my pay stubs, and they took out over 10k in taxes, 7k was for ss taxes alone. When I called they said that's not the information they had, that I was only paying 88 dollars a month on federal taxes so I gladly sent over this w2.showing them how badly they screwed up. I am not cleaning up their mess, instead I am suing them, and getting them for emotional pain and suffering too!

I have an incurable disease that's slowly killing me and they kept wanting more paperwork to prove it, even though I had testing to show I had this, and there is no treatment.And now this nighmare to deal with.

Life really seems like more trouble than it's worth

Hello could somebody answer a few question for me? i was recieving LTD through LM for 2 years after the 2 years they told me i had to file an appeal and of course they denied me so little ove 8 months later i go to court for ssi/disability and win with no changes in my conditions when i filed an appeal so now that put me behind and getting ready lose my home because they denied me can i sue them or not for not cont. to help me since i won ssi/disability with no changes.

Liberty Mutual actually made me more sick with all of their dishonest tricks.I am now negotiating a settlement with them so I won't have them in my life.

I had STD the LTD for 2 yrs. then they cancelled me. I was approved by SSDI the next day. I hired a lawyer and had filed a suit against them, and have just filed a civil suit against them and now after almost 3 yrs of fighting, my lawyer says they want to settle.

Even though I'm disabled, and should receive my monthly benefits from them, I don't want them in my life, so I'm settling. They can ruin your relationship with your doctors because they harass them and threaten them. The case manager called me one morning screaming at me saying I couldn't stay home because my paperwork wasn't complete. Yeah right, tell someone with a spinal cord injury to get to work.

They edited the survaillance tapes, cutting out parts that showed how much pain I have walking. And when I had a neck collar on and had my 82 yr old mom bringing meals over and driving me to the doctor an hr away.

They shouldn't be allowed to operate this way.How can it be legal?

Kaitlin and curt68 your cases sound exactly like mine.After collecting STD they initially denied me going from STD to LTD saying that I could do sedentary work.

I appealed on my own and they granted me LTD benefits. After two years they denied me again saying I could do sedentary work. I appealed with an attorney and they denied the appeal based on heir doctor's opinion who NEVER EXAMINED ME and even though I receive Social Security Disability and have two doctors that provided detailed medical documentation to substantiate my disability. In my 2+ years of dealing with Liberty they have stopped payments and threatened to stop payments stating that they had not received doctors reports only to find that the doctors offices provided me with fax cover sheets proving the info was faxed weeks before.

Same threat, that I was not returning their phone calls yet the number they stated in their letter isn't even close to mine, not even the same area code. I am now working with another attorney and find that I may be forced to SETTLE for an amount much less than I should.

I have also had my claim denied/closed by Liberty Mutual. I have been out of work since December 2012 and was only paid through early February 2013 at which time payments stopped. Their reasoning was my doctor was not sending appropriate documents when requested. It took them until April before they decided to close my claim based on a single conversation they had with me, where my physician had inaccurate information on my treatment. The corrected information I provided was then used against me to deny and close the claim.

I appealed and provided documents from my physician and another physician, along with information regarding my dual condition. They denied a second time and now I've hired an ERISA attorney. He advised me to file for the long term disability since I was only drawing the short term disability, as this will open Liberty Mutual up for a larger financial exposure.

Does anyone have a generic long term disability form they could share with me? I've been let go from my company and unfortunately do not have that as an option.

I paid LTD for years.I became disabled 2012.

Upon filing my claim with LM, I learned I HAD to apply for social security for me AND for my kids. I was approved thru Social Security. Now Liberty deducts what SS pays me and my kids. I knew they'd deduct my pay, but was not expecting my kids.

Plus SS requires a log of where money goes for the kids. Therefore, it's just extra work on my part.

Long story short, Liberty Mutual just got out of paying $3000 and the government now has to pay. I bought this insurance thru work so I wouldn't bother the government What a joke..

My Actual Case: $100,000 Settlement for woman who had back surgery after she was hit by a truck that was insured with Liberty Mutual Insurance. The amount of this settlement is before attorneys’ fees, doctors’ bills, etc. were deducted. The bodily injury liability policy limits were $100,000.

She had a percutaneous discectomy (back surgery on her back). After the crash, she had complaints of lower back pain. She treated with a chiropractor for a few months but the pain did not go away. She then had epidural steroid injections to her lower back. Her pain still did not go away so she had lower back surgery.

As in most cases, because the person/company that caused this accident only had $100,000 in bodily injury (BI) insurance, they did not have assets to go after. If you look at past Florida jury verdicts or ask a claims adjuster, this was an above average settlement for a case involving a herniated disc caused from an accident in Florida. Liberty Mutual also provides general liability insurance. That means that if you are injured at a hotel, store, shopping mall or other business, then you may end up dealing with Liberty Mutual. Similar to homeowners insurance, a general liability insurance policy may have “medical payments” coverage. which would pay for your medical bills regardless of fault.

My Actual Case: $31,500 Settlement with Liberty Mutual when my client’s leg was sliced up when a glass shower door broke when he was exiting the shower at a W-hotel in Fort Lauderdale, Florida. My client had pictures of the cut, which looked pretty bad. However, the cut healed very nicely and left little scarring. Scarring claims on men are generally worth less than on a woman. This is because women are generally more psychologically (mentally) affected by having a scar than a man.

This case was the perfect example of the importance of taking pictures following the incident. My client was smart and took pictures immediately after the incident. If my client did not have pictures of his injured leg, this case would probably have settled for a much smaller amount. This is because the wound healed very nicely with little scarring. Liberty Mutual insured the hotel in this case.

In the hotel case mentioned above, the hotel’s general liability insurance policy had medical payments coverage, which paid for all of my client’s medical bills. $31,500 was paid for pain and suffering, which was in addition to the medical bills.

Liberty Mutual paid this amount because they must have felt that I had a good shot at proving that the W-hotel was negligent with the type of glass door that was used in this particular shower. I believe the glass was non-tempered glass. I argued that tempered glass should have been used and would have prevented my client’s leg from being sliced up and requiring many stitches.

You may also still have a separate claim against another party (company) such as a shower glass installer even if you think you are getting a fair settlement from Liberty Mutual. Don’t expect for Liberty Mutual to tell you that another company may also be responsible to pay for your personal injury claim.

If you contact the other company and they tell you that they are not responsible for the incident or your damages, do not believe them. If an insurer tells you that it has closed your claim. it may be meaningless.

If a truck insured with Liberty Mutual hits you, then in order to get pain and suffering you have to prove that the truck driver was at fault and this caused your injuries. There is a time limit to sue for a claim based on negligence in Florida. You therefore have a limited time to sue the truck driver, company or dispatcher.

If an uninsured motorist’s negligence causes your injury in Florida, then you have five (5) years to make a claim under the uninsured (UM) coverage of an auto insurance policy with Liberty Mutual. If you have Personal Injury Protection (PIP) insurance or uninsured motorist insurance with Liberty Mutual, you should report the claim in writing to Liberty Mutual as soon as possible following the accident.
